BERGEN COUNTY WOMAN & EX-BOYFRIEND SENTENCED TO PRISON FOR STEALING $828,000 FROM STATE BY FILING FRAUDULENT TAX RETURNS

TRENTON – Attorney General Anne Milgram and Criminal Justice Director Gregory A. Paw announced that a Bergen County woman and her former boyfriend were sentenced to prison today for stealing $828,000 by filing hundreds of fraudulent state tax returns.

According to Director Paw, Rosa Victoria Rivera, a.k.a, Vicky Rocsana Rivera-Peralta, 40, of Lyndhurst, was sentenced to 10 years in state prison by Superior Court Judge Thomas P. Kelly in Mercer County.  The judge sentenced Rivera’s former boyfriend, John Arturo Perez Silva, a.k.a., John Perez, 39, of Belleville, to three years in state prison.

On Dec. 7, Rivera pleaded guilty to first-degree conspiracy to commit money laundering and theft by deception.  Perez Silva pleaded guilty at that time to second-degree conspiracy.  They agreed to pay full restitution to the state.

Deputy Attorney General Denise Grugan of the Division of Criminal Justice - Major Crimes Bureau prosecuted the case and represented the state at today’s hearing.  The investigation was led by Auditor Thaedra Chebra of the Division of Taxation - Office of Criminal Investigation and State Investigator Noelle Holl of the Division of Criminal Justice.

Rivera and Perez Silva admitted that between Feb. 6, 2004 and July 11, 2006, they, along with Rivera’s son, Wilson Armando Piños Rivera, a.k.a. Wilson Piños, 22, filed 540 fraudulent tax returns.  An audit by the New Jersey Division of Taxation determined that the returns contained similar taxpayer information, such as similar names, common addresses and common employers.  About 400 of the returns were filed electronically and the remaining returns were filed with paper. 

A majority of the refund checks were mailed to mail box drops leased by either Rivera or her co-defendants.  More than 275 checks, totaling $828,272, were deposited in bank accounts maintained by Rivera or Perez Silva, which the defendants allegedly used to pay personal expenses.  Rivera admitted that more than $500,000 in checks was deposited into accounts she maintained.  The Division of Taxation was able to stop payment on the remaining 264 checks, totaling $1,005,030.

On Dec. 19, 2006, investigators from the Division of Criminal Justice and the Division of Taxation, assisted by officers from the Lyndhurst Police Department, executed a search warrant at Rivera’s apartment and seized, among other things, a computer, stacks of tax returns, blank W-2s, blank Social Security cards, numerous driver’s licenses, passports, bank records and $191,000 in cash.  Several bank accounts of the defendants containing $139,000 were seized as well as seven vehicles owned by Rivera.

The Division of Criminal Justice obtained a state grand jury indictment on July 10, 2007, charging the three defendants.  A charge of first-degree conspiracy is pending against Wilson Armando Piños Rivera, who is being held on $750,000 bail in the Mercer County Jail.  The indictment is merely an accusation and the defendant is presumed innocent until proven guilty.

DIVISION OF RECREATION/CULTURAL AFFAIRS SCHEDULE OF UPCOMING PROGRAMS

African Dance Classes, Winter Golf, Adult Basketball heat up February

Newark, NJ - February 1, 2008 - Mayor Cory A. Booker and the Division of Recreation/ Cultural Affairs announced the division’s schedule of programs and events for the next three weeks. The schedule runs as follows:

AFRICAN DANCE CLASSES for Families:

Going on now at the Boylan Recreation Center every Thursday from 6:15 p.m. to 7:45 p.m., African Dance instruction will be offered weekly. This pilot program will feature a drummer and is conducted by a seasoned instructor - Mama Yaa. Classes are limited to 25 persons. LIFE SKILLS Classes for Children aged eight to 11:

Going on through Friday, February 22, the Boylan Recreation Center is offering free Life Skills classes for 15 youngsters aged eight to 11, to help them with such issues as self esteem; building confidence; dealing with stress; communication and social skills. These classes are intended to keep them from developing bad habits and help them make wise life choices. The instructors come from Family Connection, a Maplewood-based social service agency that has collaborated with the Division of Recreation/Cultural Affairs in the past. Light refreshments are served. BALLROOM DANCING Classes for Adults:

Due to popular demand, the division is offering Adult classes in Ballroom Dance at the Rotunda Recreation Center, at 75 Clifton Avenue, on Thursday evenings from 6:15 p.m. to 7:45 p.m. Classes are offered on a first-come, first-serve basis to adults aged 18 and up, and the class is limited to 30 persons. WINTER GOLF for Youth:

The City of Newark’s Smart Golf/Hook-A-Kid on Golf Intermediate and Advanced Training Program has begun, and will continue until March 19. The Smart Golf program is aimed at newcomers to the sport, while the Intermediate and Advanced Program is a follow-up for youngsters who attended the city’s basic golf programs this summer. The program is open to Newark children aged 8 to 16.

The program takes place at two sites: the Boylan Recreation Center at 916 South Orange Avenue on Mondays, and the John F. Kennedy Recreation Center at 211 West Kinney Street on Wednesdays, from 5:30 p.m. to 7:30 p.m.

The program is co-ed, and participants learn a variety of golf techniques from certified golf instructors, provided by Newark Youth Golf, Inc. Equipment is provided by the Division of Recreation/Cultural Affairs.

BALLROOM DANCING Classes for Youth:

Newark youngsters ages 11-17 can learn ballroom dancing. LEARN TO SWIM/YOUTH SWIM Team Programs:

Open enrollment evaluations for the Learn-to-Swim classes are conducted daily at John F. Kennedy Aquatic Center and Ironbound Aquatic Center from 3 p.m. to 7 p.m., Monday through Friday, and from 10 a.m. to 5 p.m., on Saturday, based upon Water Safety Instructor (WSI) availability.  Parents of team participants will be able to choose the most convenient schedule for their children.

Recreation is embarking on a new day in Aquatics for the City of Newark with an earlier opening ideal for Adult & Senior Learn-to-Swim lessons, as well as offering for the first time Corporate, Master and Senior. Master Lap Swims for former swimming competitors; those who love early swim workouts, and those interested in maintaining a healthy mind and body. Classes are offered from 7 a.m. to 10 a.m. at the JFK Pool and from 9 a.m. to 7:30 p.m. at the Ironbound pool, Monday through Friday.

The JFK Aquatic Center is now open at 7 a.m., Monday through Friday, with closing hours of 8 p.m., Monday through Friday. Saturday hours are 9 a.m. to 6 p.m., remaining the same. Both pools are closed on Sunday. For more information, call (973) 733-4384.

WATER AEROBICS for Adults and Seniors:

The Division of Recreation offers training courses for adults who would like to serve as coaches, administrators, or officials in youth sports. The classes are certified by the National Alliance for Youth Sports, and all persons who complete the classes will receive a certificate in that class, which recognizes the participant as an official member, which also insures them against liability. EVENING ADULT WORKOUT Programs:

Stretch your body and relieve the stress of a hard day at work before going home with the John F. Kennedy Recreation Center’s Evening Adult Workout Programs. These classes are provided by the PowerZone and the Recreation Center’s Get Fit Challenge.

FREE Swimming, Basketball, Weightlifting, and Physical Exercise programs take place Monday through Friday from 6:30 p.m. to 9:30 p.m. at the recreation center, and on Saturdays from 11:00 a.m. to 1:00 p.m.

STREET HOCKEY for Youth:

HOMEWORK AND TECHNOLOGY for Youth:

All recreation centers offer Newark youngsters free access to computers and tutoring to help them with homework and to learn modern technology, Monday through Friday, 3 p.m. to 4:30 p.m. Adults can participate based on registration: Adult times will be announced. CHESS for Youth and Adults:

NEWARK DISTANCE CLASSIC for Youth and Adults:

This annual 5K and 20K run has been moved to Sunday, March 9, 2008, starting at 9:30 a.m. Awards will be given out for the top three male and female overall finishers, as well as the top three male and female finishers in various age groups. Businesses, schools, colleges, and other groups may compete with male, female, or co-ed teams for top three finishers in the “team” categories.

The race is certified by the USA Track Federation for New Jersey. All registrations postmarked before March 2, 2008, are $20. Registrations postmarked after that cost $25. USATF-NJ members take a $2.00 discount on registration. Registration closes at 9 a.m. on race day, Sunday, March 9, 2008. Everyone competing in the run will receive a race souvenir t-shirt. Runners muster for the race by 9 a.m. at Rutgers University Gymnasium (Golden Dome), located at 42 Warren Street, Newark, New Jersey.

MUNICIPAL COURT PLANS MASS WEDDINGS FOR ST. VALENTINE’S DAY

Newark court will perform nuptials and civil unions from noon to 4 p.m.

Newark, NJ - February 1, 2008 - Mayor Cory A. Booker announced today that the Newark Municipal Court is working to spread St. Valentine’s Day joy by scheduling as many weddings and civil unions as possible for that date, and is urging couples planning to marry at the Municipal Court to do so on that day.

The Municipal Court will, as it has in years past, mobilize its judges and staff to hold up to 125 wedding and civil union ceremonies that day. The Court will provide couples with a complimentary photograph taken under the Court’s wedding trellis as a memento of their special day.

Reservations and marriage license applications must be made in advance. Weddings will be held from noon to 4 p.m.

“St. Valentine’s Day is a special day symbolic of love and friendship. It is with great joy that I announce our Municipal Court continues the tradition of making dreams come true for Newark couples who want to exchange wedding vows on this day,” Mayor Booker said.

The court staff will process marriage licenses and civil union certificates and guide the couples to courtrooms, where judges will be assigned in rotation to perform each ceremony individually. Interpreters will be available to assist persons who speak Spanish and Portuguese.
